1. About these terms

These terms and conditions (“Terms”) apply to your use of rosecityawning.com and its pages (the “Site”), operated by Rose City Awning & Flag (“we,” “us” or “our”), 2728 NW Nela St, Portland, Oregon 97210.

By using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site. Our Privacy Policy explains how we handle information you send us and is part of these Terms.

2. Using the Site

You may use the Site to learn about our products and services, request an estimate, and contact us. Please don’t misuse it: don’t try to break or overload it, gain access to parts that aren’t public, send malicious code, submit false or misleading information, or use automated tools to copy its content in bulk.

We may change, pause or remove any part of the Site at any time.

3. Information on the Site

We work to keep the Site accurate and current, but product lines, fabrics, options, features and availability change, and manufacturers update their products. Descriptions, guides and blog posts are general information, not advice for your specific building.

Photos show work we have done or products we carry. Colors on screen vary, and every project is different, so your finished awning may not look exactly like a photo. Blog posts are dated and reflect what was true when they were written.

4. Estimates, ballparks and quotes

Nothing on the Site is an offer to sell or a binding price. Ballparks, cost guides, the estimate-request builder, the lettering preview and any figures we give from photos are estimates only.

A project is agreed only through a written quote or agreement from Rose City Awning & Flag, usually after a site visit. That written quote or agreement, including its own terms for price, scope, schedule, payment and warranty, governs your project and controls if it differs from anything on the Site.

5. Estimate requests and messages

When you send an estimate request, a question or photos, please give accurate information and only send photos and details you have the right to share. You confirm you are at least 18 years old.

Sending a request doesn’t commit you to anything. It lets us contact you by phone or email about your project. We don’t add you to marketing lists from a request.

6. Flags and flagpoles

Flags are sold through our online store at store.rosecityawning.com, which runs on Shopify and has its own policies for orders, shipping, returns and privacy. Those policies, not these Terms, apply to store purchases.

Flagpoles are ordered by phone. Pricing, delivery and any other terms for a flagpole order are confirmed with you when you order.

7. Our content and other trademarks

The Site’s text, photos, graphics, illustrations, page designs and our name and logos belong to Rose City Awning & Flag or are used with permission. You may view, print or share pages for personal, non-commercial use, such as sending a page to a family member or a landlord. Please don’t copy, republish or sell our content without written permission.

Product and brand names such as SummerSpace, Sunbrella, Tempotest, Somfy, Awnex, Bolander and 3M Scotchcal belong to their owners. Business names and logos that appear in photos of our work belong to those businesses. Their appearance doesn’t mean they endorse us.

8. Links and third-party services

The Site links to and includes services we don’t control, such as Google Maps, our Shopify flag store, manufacturers’ websites, city code pages and social media. Their own terms and privacy policies apply, and we aren’t responsible for their content or practices.

9. Disclaimer

The Site is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties about the Site, express or implied, including that it will be uninterrupted, error-free or free of harmful components.

This disclaimer covers the website only. Any warranty for products or work you buy from us is stated in your written quote or agreement, or in the manufacturer’s warranty.

10. Limitation of liability

To the fullest extent the law allows, Rose City Awning & Flag is not liable for indirect, incidental, special or consequential damages arising from your use of, or inability to use, the Site. Nothing in these Terms limits liability that cannot be limited under Oregon law.

11. Governing law

These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law rules. Any dispute about the Site will be handled in the state or federal courts located in Multnomah County, Oregon, unless the law requires otherwise.

12. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top shows when they last changed. Using the Site after an update means you accept the updated Terms.
